- Updating Employee Handbooks: How California employers need to update their employee handbooks to comply with changes in the law for 2023, including with respect to sick leave, California Family Rights Act ("CFRA") leave, bereavement leave, and San Francisco's new Public Health Emergency Leave Ordinance; legal adjustments that employers need to make for employees working outside of California under several new state/local laws; and, how a recent court ruling found that an employee had enough evidence to proceed with a claim based upon ambiguity in the employer's leave policy, despite the employee's lack of clarity when communicating the reasons for his absences.
- Pay Transparency Laws: New requirements in 2023 for California employers under Senate Bill 1162, including requirements to include a pay scale for a position with every job posting, to provide a pay scale upon request to employees (previously, this applied only to applicants), and to prepare/submit to the California Civil Rights Department pay data analyses relating to race, ethnicity and sex. In addition, we'll review some key additional pay transparency law requirements that apply to employers with employees in other states.
- Layoffs: With layoffs on the rise, we’ll provide a general review and update on special laws and best practices relating to layoffs, including special requirements for severance and release agreements, assessing wrongful termination claim risks with respect to employee layoff selection, recommended documentation to support the business case for a layoff and layoff selections, and the California and federal WARN Acts.
- Commission Pay Plans: As many employers are updating commission pay plans for 2023, we'll review our top 10 list of legal mistakes employers make with their commission plans, and how to avoid them.
- Wage & Hour Law Update: Review of minimum pay requirements for exempt and non-exempt employees, including recent increases.
- Cannabis Use: A wave of new laws inside and outside of California expanding legal protections for applicants and employees to use cannabis (outside of work!).
- Employee Arbitration Agreements: An update on fast-evolving law, including with respect to mandatory versus optional arbitration agreements, federal law excluding sexual harassment/assault cases from arbitration, and California Private Attorney General Act claims.
- Update on COVID-19 Related Law: Cal-OSHA's new Non-Emergency COVID-19 Prevention Regulations, which will replace the COVID-19 Prevention Emergency Temporary Standards (ETS) in January 2023; how to handle employee absences related to COVID-19 after the expiration of California's COVID-19 supplemental paid sick leave on December 31, 2022.
