Our 2017 Employment Law Update Seminar series will address numerous new California state and local laws, and include a special focus this year on federal law developments. We’re holding our seminar several days after the January 20 presidential inauguration, to address early actions of the Trump administration.

The seminar will address:

  • Federal Law:  Immediate actions of the Trump administration, including with respect to the status of FLSA exempt salary regulations, and reversal/modification of President Obama’s Executive Orders; also, anticipated future actions by the Trump administration and Republican Congress.
  • Hiring Process:  New California law restricts documents that employers may request to establish authorization to work; new California law restricting inquiries into criminal history when the employee or applicant was a juvenile.
  • Sexual Assault, Domestic Violence, & Stalking Victims:  New California law requires employers to give a notice of rights to all new hires starting July 1, 2017.
  • Exempt & Non-Exempt Pay Requirements:  California’s new increases to minimum wage, exempt salaries, and pay for exempt computer professionals.
  • Equal Pay:  New California laws restrict the ability of employers to justify salary differences based upon prior salary history, and expand California Equal Pay Act provisions to apply to race and ethnicity.
  • Age Discrimination:  Lawsuits targeting tech companies that are spurred on by managerial comments allegedly indicative of age bias; $16 million jury verdict for wrongful termination of Staples manager.
  • Restrictions on Employee Agreements:  A new California law prohibits employers from requiring employees to agree to litigate or arbitrate outside of California, or to apply non-California law to disputes arising in California.
  • Interference With Employment:  California court ruling that an employee could claim interference with employment based upon a third party convincing his employer to fire him, regardless of whether the third party’s conduct was independently a wrongful act.
  • Arbitration:  New court rulings on whether arbitration agreements may contain class action waivers.
  • Sick Leave Laws:  We’ll catch you up on the ongoing tidal wave of new city minimum wage and sick leave requirements, which must be satisfied as to employees working in the specified locations.
  • Disability Accommodation & Leave:  Court ruling that an employer could be held liable for failing to satisfy an employee’s “implied” request for accommodation; court ruling that approved of an employee’s ability to claim that a change in his shift was discrimination based upon his “association” to a person with a disability; court ruling that an employee could sue for wrongful termination based on his employer having provided insufficient information about his leave of absence rights when he needed time off for depression and alcoholism.
  • Paid Parental Leave:  San Francisco’s new rules implementing the Paid Parental Leave Ordinance.
  • Rest Breaks:  California Supreme Court ruling that employers may not require employees to remain on-call during rest breaks.
  • Toilet Facilities:  New California law requires single user toilet facilities to be identified as all-gender facilities effective March 1, 2017.
