The time is now for employers to begin developing their sales commission plans for 2024! California law generally requires reasonable advance notice for commission plan (and other policy changes), and does not allow changes to be made retroactively (i.e., to January 1 if published thereafter).

Watch this complimentary on-demand (recorded) webinar for a detailed review of California's surprisingly stringent laws on commission pay, including:

  • Often-overlooked statutory commission pay plan requirements.
  • Legal requirements to pay a commission to a former employee, regardless of the plan's language.
  • Precise plan language requirements required to prevent "chargebacks" from being considered unlawful deductions from earned wages.
  • Checklist of key commission plan provisions, and common employer mistakes with commission plans.
  • Legal restrictions on when an employer may modify or terminate a previously published commission plan, regardless of the plan's modification/termination language.
  • Why the law generally requires most sales staff to be non-exempt (overtime eligible), other than managers and traveling salespersons.
  • How overtime pay must account for commissions.
