While on the one hand it seems that 2020 cannot end fast enough, it’s also time for California employers to catch their breath and update their handbooks, policies, and practices to comply with legal requirements effective January 1, 2021. This webinar aims to give you a good head start. We’ll cover:
- Leaves of Absence: Expansion of the California Family Rights Act (“CFRA”) to require employers with 5 or more employees (previously 50+ employees) to provide eligible employees with legally protected family and medical leave; expansion of CFRA leave rights as to employers with 50+ employees; and, expansion of other California leave laws that employers should update their handbook policies to address.
- “Unlimited Vacation”: Updating policies in light of the first reported California Court of Appeal decision related to “unlimited” vacation policies, McPherson v. EF Intercultural Foundation, Inc., (holding that the employer was required to pay terminated employees for unused vacation, despite the employer’s argument that it had an “unlimited” non-accrual vacation policy); we’ll review common mistakes involving unlimited vacation practices that run afoul of McPherson, and how to update vacation policies and practices in light of this important ruling.
- COVID-19 Related Employment Laws: Review of federal and California state/local laws related to the pandemic, and when they expire.
- New Wage Law Requirements: New heightened pay requirements for exempt computer software professionals and “white collar” exempt employees; new minimum wage requirements for non-exempt employees.
- Independent Contractor Status: California’s recent amendment to AB 5 (creating a complex slew of new exceptions), and a high-level review of Proposition 22.
- Sexual Harassment Prevention Training: California’s requirement for employers with 5+ employees to provide 2 hours of training to supervisors, and 1 hour of training to non-supervisors, before January 1, 2021; special requirements for virtual webinar trainings.
