California’s New Sick Leave Law (3-26-15 Webinar Recording)

This complimentary webinar reviews California’s new paid sick leave law, the Healthy Workplaces, Healthy Families Act of 2014.  This may be the most significant new California employment law in years, in that it will require virtually all employers to revise their policies and practices concerning sick leave-including employers that already provide more than the minimum amount of leave through either traditional sick leave or PTO policies.

This webinar reviews:

  • Which employers and employees are covered; when employers must comply with the law’s various provisions.
  • The accrual requirement, accrual cap, usage cap, carry over requirement, and requirement to reinstate unused sick leave upon re-hire of an employee within one year.
  • Qualifying reasons employees are entitled to use sick leave, and the lack of authorization for employers to require any form of medical documentation.
  • Anti-retaliation provisions and monetary liabilities.
  • Notice and record keeping requirements.
  • Key provisions to review/revise in existing sick leave and PTO policies, and how the law impacts unaccrued vacation/PTO plans.
  • How the law impacts attendance management by making inherently unpredictable sick leave absences legally protected, and may disproportionately complicate attendance management for employers that make general PTO available for sick leave use (i.e., instead of separating vacation and sick leave benefits).
  • Important differences between the new state law and the San Francisco Sick Leave Ordinance, and a new Oakland municipal code provision requiring sick leave.
