This year brings more change to California leave laws than any year in recent memory. Attend this live seminar to learn about key new developments, and for an A-Z review of California’s vast array of employee leave laws. The program will address hot leave topics including:

  • Wide-ranging changes to the California Family Rights Act’s (“CFRA”) regulations that take effect July 1, 2015, including prescription of a new medical certification form, incorporation of 2013 federal FMLA regulations (in lieu of the 1995 FMLA regulations) in several areas, and how the changes affect important matters including employee bonus eligibility and exempt employee pay.
  • A new ruling by the California Supreme Court in a case about whether an employer may terminate an employee for violating a policy against working another job during medical leave, and/or for an “honest belief” of leave fraud.
  • FMLA’s ban against requiring a second opinion on return to work medical certifications, and a recent California court ruling that approved an alternative approach for requiring a separate fitness for duty examination following FMLA leave.
  • Significant FMLA court rulings on issues including the impact of an employee affirmatively declining to use FMLA leave, how the employer may be held liable for even a manager’s ineffective discouragement of FMLA use, and employer liability for failing to communicate clearly about the amount of available leave.
  • Medical leave rights of FMLA-ineligible employees under ADA, including recent developments on when temporary impairments may qualify as an ADA disability, and a court ruling that an employer’s unilateral modification of a leave expiration date may violate the ADA’s interactive process requirement.
  • 2014 EEOC Enforcement Guidance on Pregnancy Discrimination, and differences between California and federal laws on pregnancy disability leave and accommodation.
  • Employee leave rights for substance abuse rehabilitation.
  • Updates on California’s new sick leave law, and which other U.S. states/cities impose paid sick leave requirements.

Time will also be reserved for attendee questions during the program. All attendees will receive detailed PowerPoint slides and additional written materials concerning the subjects addressed.

Your presenters will be attorneys Ray Hixson,  Brian Nagatani, and Mary Wang, who are partners of the law firm Hixson Nagatani LLP.  Hixson Nagatani LLP advises and represents employers in a wide range of employment law matters.  The firm provides advice and counsel on proactive steps that employers should take to ensure compliance and minimize legal risks, including with respect to creating and updating personnel policies and practices, personnel-related forms, risk assessment of contemplated personnel actions, and managers’ legal training.  The firm also defends employers against actual and threatened employee claims, including claims made in state and federal courts, arbitration, and government agencies.
